Business Litigation

Ciampa Fray-Witzer, LLP combines substantial litigation experience and business savvy to provide effective, practical representation in all manner of business disputes.  With more than 30 years of collective litigation experience, the Firm provides strategic solutions specifically tailored its clients’ business needs.

The Firm maintains an active business litigation practice before the state, federal, and appellate courts of Massachusetts and New Hampshire, including regular appearances before the Commonwealth’s Business Litigation Session.  In addition, the Firm regularly appears before arbitration tribunals such as the American Arbitration Association (AAA), and Financial Industry Regulatory Authority (FINRA).

The Firm routinely represents partners and shareholders in closely-held corporation in their pursuit or defense of claims sounding in breach of fiduciary duty, minority freeze-out, and business fraud.  The Firm also regularly represents its corporate clients in disputes with customers, vendors, competitors, and former employees involving breach of contract, issues concerning non-competition, non-solicitation, and trade secret misappropriation, intellectual property infringement, and unfair competition.

Despite excelling in the courtroom, the Firm recognizes that a client’s interests are often best served by a non-judicial resolution.  Accordingly, the Firm’s attorneys are equally accomplished in the mediation process and in generally negotiating voluntary settlements on behalf of their clients.

In addition, Ciampa Fray-Witzer provides a full complement of services directed at the negotiation, drafting, and review of written agreements, including service contracts, independent contractor agreements, non-disclosure agreements, employment agreements, non-competition, non-solicitation, and non-disclosure agreements, and severance agreements.
